Terms of Use

These Terms of Use govern the use of the Spraydex app, the spraydex.com.br website and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you declare that you have read, understood and accepted these Terms and our Privacy Policy. If you use the Service on behalf of a company, you represent that you have authority to bind it to these Terms.

2. Description of the Service

Spraydex is an agricultural spraying analysis app: from photos of water-sensitive papers, it estimates application metrics (such as droplet count, coverage and diameters) and generates reports. The Service is a decision-support tool and does not replace the technical judgment of a qualified professional (e.g., an agronomist).

3. Registration and account

To use most features, you must create an account with truthful, complete and up-to-date information. You are responsible for keeping your password confidential and for all activities carried out under your account. Notify us immediately of any unauthorized use.

4. Third-party data (clients and properties)

The Service lets you register and process third-party data, such as your clients and their properties. By entering this data, you represent and warrant that you have a legal basis and authorization to collect and process it, and that you will use it only for legitimate purposes. With respect to this data, you act as the controller and are responsible for complying with applicable data protection law; Spraydex acts as the processor, handling it according to your instructions and our Privacy Policy. You agree to hold Spraydex harmless and indemnify it against any third-party claims arising from entering such data without proper authorization.

5. Plans, subscription and payment

The Service offers a free plan with a limited number of analyses (and possible bonuses) and paid subscription plans. Payments are processed by external payment providers, in the available methods (PIX, card and boleto). The applicable prices, frequency and conditions are presented at the time of purchase. There is no in-app purchase; plans are contracted through the indicated channels.

6. Acceptable use

You agree not to: (a) use the Service for unlawful purposes; (b) enter third-party data without authorization; (c) attempt to access areas, systems or data without permission; (d) reverse engineer, copy or exploit the Service in an unauthorized way; (e) overload, disrupt or compromise the security of the Service; or (f) use the Service in a way that violates third-party rights.

7. Intellectual property

The Service, including software, trademarks, layout and content, belongs to Spraydex or its licensors and is protected by law. These Terms do not transfer to you any intellectual property rights, except the limited, personal and non-transferable license to use the Service as provided herein. The data you enter remains yours.

8. Limitation of liability

To the maximum extent permitted by law, Spraydex shall not be liable for indirect damages, lost profits, data loss or losses arising from the use of or inability to use the Service, nor for decisions made based on the analyses. Nothing in these Terms limits liabilities that cannot be limited by law.

9. Suspension and termination

You may close your account at any time. We may suspend or terminate access to the Service, in whole or in part, in the event of a breach of these Terms, legal requirement or discontinuation of the Service. After termination, the processing of your data will follow our Privacy Policy.

10. Bad-faith use, espionage and legal measures

We may suspend, block or revoke, at any time and without prior notice, the access of any user or subscription if we identify bad-faith use, fraud, attempts to circumvent limits or payments, or any sign of espionage, industrial espionage or acting on behalf of competitors.

The same applies to any attempt to copy, reproduce, decompile, reverse engineer or make unauthorized use of the Service, its technologies, methods or content. In such cases, in addition to administrative measures, we may automatically notify the competent legal authorities and take the applicable civil and criminal measures to protect our rights.

11. Changes to the Terms

We may change these Terms at any time. The current version will always be available on this page, with the date of the last update. Continued use of the Service after significant changes constitutes acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Caxias do Sul, State of Rio Grande do Sul (Brazil) are elected to resolve any disputes, except where consumer-protection law provides otherwise.
